Why is it so hard for airline companies to give passengers the compensation which legitimately corresponds to them when they claim on their own?
The answer is simple. By disregarding the claims that individual passengers make on their own, a lot of them fall by the wayside. This happens because not all passengers turn to law experts to take the claims further, so the airline companies end up saving money.
Will I have to attend the trial?
In the case of taking legal action, the airline will normally contact us to get to an agreement, so you will not have to attend the trial.
In the case of legal proceeding, will I have to pay any extra costs?
No, we only charge 25% plus VAT of the amount that is gained, independently of how we got it (judicially or extra-judicially)
If I don’t get a compensation, will I have to pay anything?
No, we only charge in case of success.
How long can the claiming process take?
This depends on different factors. Supposing that the extra-judicial claim is disregarded by the airline company and we start a judicial process, the length of the process will depend on two variables:
the court’s workload.
the willingness of the airline company to get to an agreement
If we can get to an agreement with the airline and don’t have to go to court, the process will be much faster.
How long should a delay be to be eligible for an economic compensation?
According to the jurisprudence of the Court of Justice of the European Union, the delay must be equal or higher than 3 hours.
If the delay is so long that it is doesn’t make sense for me to fly anymore, what can I claim?
In this case you could claim the ticket cost, the compensation for great delay and moral damage.
I missed a connecting flight because I had a delay on the first one. What can I claim?
You can claim the corresponding compensation taking into account the distance between the point of departure and the point of destination.
I have had an incidence with a flight I took for work purposes and that was paid by my company. Can I still claim a compensation?
Yes, the passenger is always the entitled person and has the right to present the claim.
What can I do if my flight is advanced?
This is like a flight cancellation, so you have the right to make a claim.
My flight had overbooking and I got to an agreement with the airline company to not take the flight. Can I claim anything else?
If you have signed a waiver of your rights to make a claim, you will not be able to claim anything else. Nevertheless, if you haven’t signed it and the amount the airline gave you is lower than the one that corresponds to you, you can claim the difference between both amounts.
The airline company claims that the incidence is due to technical errors or a fault with the airplane. Can I still make a claim?
Yes, you can. The airline company cannot use this reason to not compensate its passengers. This has been established repeatedly by the jurisprudence of the Court of Justice of the European Union.
The airline company claims that the incidence is due to adverse weather conditions. Can I still make a claim?
Even though it can be a cause of exemption, the company must prove that the weather really affected your specific flight. For example, if on the same day other flights took off from the same airport, everything would suggest that the incident was due to a different kind of problem.
The airline company claims that the incident is due to the effects of a strike. Can I still make a claim?
Strikes can be of different natures and with different characteristics (airline staff, airport staff…) So we will have to evaluate each specific case to see if the type of strike can be a cause of exemption for the airline.
I started the claim through you and the airline company has now contacted me directly. What should I do?
You should contact us immediately because sometimes the airline companies try to get to an agreement with the individual passengers so they can close the claim with a lower amount.
What is the no-show clause?
It is the practice that many airlines use consisting on cancelling the return flight when you haven’t showed up at the first flight. It has been considered as an abusive practice and the passenger has the right to make a claim.
